Bertrand du Marais

Bertrand du Marais, ESSEC (1985) et ENA (1989) is Councillor of State (Conseiller d’Etat). He is currently a member of the Civil Works Section (Section de l’administration) in the Advisory branch of the French Conseil d’Etat where he more specifically deals with Network Industries Regulation, Public Procurement and Environment Law. He has been elected by the Conseil d’Etat to join CNIL, the French Data Protection Agency, in February 2019 and is the Commissioner more specifically in charge of International Affairs, e-Privacy and Platform Regulation and member of the sanction board.
Prior to coming back to the Conseil d’Etat in 2015, he spent a decade seconded at the Université of Paris West at Nanterre as Law Professor. He has founded and co-chaired the Law and Economics programme (Master and Bachelor), with altogether 400 students. He teaches Public Utility and Regulation Law and Law and Economics. He currently chairs Fides (Forum sur les interactions entre le droit, l’économie et la société: http://www.fides.institute ), a non profit Think Tank that serves as catalyst for international multi-disciplinary research on the interactions between Law, Economics and the Society. He is a member of the board of France-Amériques, a French Think Tank devoted to Transatlantic relationships.
His textbook on Market Regulation and Public Utility Law (Droit public de la régulation économique) has been awarded the 2004 Charles Dupin-Medal by the French Academy for Political and Social Sciences. He has extensively published in this field as well as in information and communication technologies, comparative Law and Economics and in Public Law. He has been awarded the Zerrili Marimo Prize in 2000 from the French Academy for Political and Social Sciences.
