Methodology

A Master Class is a high-level event for professionals and officials involved in State aid. Its purpose is to review important developments in State aid case law and the European Commission’s decisional practice, assess their implications for Member States, and improve your national State aid measures.

The sessions combine presentations, case studies and discussions on practical issues. You will have ample opportunities to present your issues and discuss them with speakers and participants from other countries.

Review and Assessment

On the first day, you receive an expert review of the latest Court rulings and Commission decisions. Seminal judgments and decisions are analysed in depth. The analysis identifies how principles are applied in specific situations, delineates possible exceptions; and draws out the implications for State aid policies.

Problem-Solving

The second day is devoted to the participants’ presentations of cases and questions submitted in advance. State aid measures, problems, and other issues from your daily practice are discussed in full confidentiality. Participants receive advice on how to improve their measures and ensure their compatibility with the internal market.

Best Practices

On both days, the format of this advanced small-scale Master Class enables you to consider wider relevant issues in the field of State aid as well as exchange information and experiences with peers from other countries.

Who should attend?

This high-level event is intended for officials and professionals who have good knowledge of State aid or are working on projects that may involve State aid. The acquaintance with the principles of State aid law and its several regulations is essential for the participation in the experts’ discussion on the recent developments in State aid and their implications for the practice.

  • The concept of economic activity and undertaking
  • How economic activities may be separated from non-economic activities; prerogatives of the State
  • Concept of direct or indirect control of resources by the State; imputation of a decision to the State
  • Nature of the advantage that undertakings may obtain from State intervention; compensation; MEIP & MEOP
  • The conditions under which public measures become selective, with special attention to tax measures
  • The extent to which cross-border trade and competition may be distorted

The Master Class will analyse measures approved by the Commission on subjects and in sectors such as:

  • Compensation for damage
  • Remedy of a serious economic disturbance

  • Research, development and innovation (R&D&I)
  • Infrastructure; energy infrastructure
  • Regional investment
  • Risk finance and measures where aid was prohibited, e.g.

Case Analysis & Advice on Possible Solutions for the Problems Raised by Participants (incl. 30 min Coffee Break)

On the second day of the Master Class, Phedon Nicolaides analyses the participants’ cases. Each participant has the exclusive opportunity to have a one-on-one meeting with him to discuss their case and receive ad hoc advice directly from the speaker. The lessons drawn from the review on the first day will be used to analyse any problematic aspects of the submitted cases and identify possible solutions.
